General Terms and Conditions (GTC) of TourismusRegion Baden AG
We are pleased that you are interested in the products of TourismusRegion Baden AG (hereinafter: TRB AG), and we thank you for the trust you have placed in us. Please take the time to read the General Terms and Conditions (hereinafter: GTC) carefully. For general questions or questions regarding the GTC, you may contact us at any time at info@deinbaden.ch.
1. General Provisions
The contract is concluded between the customer and TRB AG (Badstrasse 31, 5400 Baden). The customer must accept the GTC at the time of placing the order. By confirming the order, the customer agrees to the GTC. Any general terms and conditions of the customer are hereby expressly rejected.
2. Online Shop
2.1 Registration
When entering the personal data required for registration, the customer is responsible for providing truthful and complete information.
The customer must refrain from any interference with the website or any use of accessible data beyond what is intended within the platform. Manipulations aimed at obtaining unauthorised payments or other advantages to the detriment of TRB AG may result in legal consequences.
2.2 Ordering and Payment
Products offered on onlineshop.deinbaden.ch can be ordered easily and securely. Fees may be paid by credit card (Mastercard, Visa, Postcard), online banking via PostFinance Card E-Finance, or via the online payment service TWINT.
2.3 Delivery Conditions
The customer will generally receive the goods within five working days. In case of delays, we will inform the customer immediately. Delivery is carried out by post. Deliveries are made only within Switzerland and Liechtenstein.
2.4 Returns & Exchanges
Items that are defective or damaged upon receipt must be returned by the customer to TRB AG no later than 3 working days after discovery. TRB AG will promptly send a replacement. Returns due to dislike are excluded.
2.5 Prices
All prices include VAT. Price changes are reserved; however, the prices valid at the time of ordering are binding.
2.6 Shipping Costs
Shipping costs depend on the total amount in the shopping cart. Shipping costs also include packaging fees.
2.7 Refusal of Acceptance
In the event of an unjustified refusal to accept goods delivered by TRB AG, TRB AG will charge the customer for any costs incurred.
2.8 Retention of Title
Goods remain the property of TRB AG until full payment has been received.
2.9 Youth Protection
TRB AG does not sell alcohol to persons under the age of 18. By purchasing such products, the customer confirms that they are at least 18 years old and meet the legal requirements.
3. Private City Tours
3.1 Conclusion of Contract
The contract between the customer and TRB AG is concluded upon acceptance of the city tour booking, whether made by telephone or in writing.
3.2 Execution
Tours take place in all weather conditions. The maximum group size is 25 people. From 26 people onwards, two groups will be formed. An ideal group size is up to 20 people.
3.3 Prices & Discounts
The prices listed in the current tour programme apply. School classes (primary and vocational schools) receive a discount of CHF 50.00. All prices include VAT.
3.4 Vouchers
Vouchers must be submitted no later than the day of the tour to the tour guide or at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) for billing. Late submission or failure to submit the voucher may result in the voucher not being redeemable for the booked tour.
3.5 Surcharges
Customised tours and changes to the tour theme are subject to a surcharge of at least CHF 50.00 or charged according to the effort required. For tour extensions, CHF 85.00 is charged per started half-hour.
3.6 Rebooking, Cancellation & Delays
A one-time rebooking after the booking confirmation, up to 8 days before the tour, is free of charge. For multiple rebookings after the booking confirmation up to 8 days before the tour, a fee of CHF 40.00 per rebooking applies. A rebooking made less than 8 days before the tour is considered a cancellation. The following cancellation conditions apply:
Cancellation up to 8 days before the tour: CHF 80.00
Cancellation 7–3 days before the tour: 50% of the price
Cancellation 2–0 days before the tour or no-show: 100% of the price
In case of late arrival of the group, any additional time may be charged, or the duration of the tour may be shortened.
3.7 Payment
The invoice will be sent to the customer after the tour. In exceptional cases, TRB AG accepts cash or credit card payments at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) or cash payments directly to the tour guide.
3.8 Late Payment
The invoice must be paid within 30 days from the invoice date without deductions. If payment is not made within 30 days after the due date, the customer is in default. In this case, TRB AG reserves the right to charge reminder fees in addition to the invoice amount. While no fee is charged for the first reminder/payment notice, the fee for the second reminder is CHF 10.00 and CHF 20.00 for the third reminder. The outstanding invoice amount (including interest on arrears and reminder fees) may be forwarded or sold to a debt collection agency for collection.
3.9 Insurance
TRB AG accepts no liability for accidents occurring during city tours. Insurance is the responsibility of the participants.
4. Public City Tours
4.1 Conclusion of Contract
The contract between the customer and TRB AG is concluded upon purchase of the ticket. Tickets may be purchased on site from the tour guide or in advance online or at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden). For online purchases or purchases at the Info Baden Tourist Office, the booking confirmation serves as the ticket and must be presented to the tour guide at the beginning of the tour.
4.2 Execution
Public city tours take place in all weather conditions. The maximum group size is 25 people. Customers are asked to arrive at the meeting point 10 minutes before the start of the tour. Late arrivals cannot be waited for.
4.3 Prices & Discounts
The prices listed in the current public tour programme apply. All prices include VAT. Holders of a City Ticket may participate in public tours (excluding special tours) free of charge. They are asked to make the booking in advance at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) or directly on site with the tour guide. The City Ticket cannot be redeemed or applied for online purchases. Presenting a valid City Ticket when purchasing tickets for public city tours is mandatory.
4.4 Vouchers
Tickets purchased with a voucher must be obtained in advance at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) or on the day of the tour directly from the tour guide. Vouchers cannot be redeemed or applied for online purchases. Presenting the voucher when purchasing tickets for public city tours is mandatory.
4.5 Payment
For online purchases, fees may be paid by credit card (Mastercard, Visa, Postcard), online banking using PostFinance Card E-Finance, or via the online payment service TWINT. At the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden), payment in cash or by credit card (Mastercard, Visa, Postcard) is possible. With the tour guide, payment can be made in cash.
4.6 Returns & Exchanges
Exchanging or returning purchased tickets is excluded.
4.7 Insurance
TRB AG accepts no liability for accidents occurring during city tours. Insurance is the responsibility of the participants.
4.8 Personal Data
For online purchases, the customer data required for ticket sales is transmitted in encrypted form (SSL).
5. Urban Golf Baden
5.1 Conclusion of Contract
The contract between the customer and TRB AG is concluded upon purchase of the ticket. Tickets must be purchased in advance online or at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden). For online purchases or purchases at the Info Baden Tourist Office, the booking confirmation serves as the ticket and must be presented at the material pick-up point at the beginning.
5.2 Execution
Urban Golf can generally be carried out in any weather. However, snow may make the activity more difficult. The maximum group size is 6 people.
5.3 Prices & Discounts
The prices published on the Urban Golf website apply. All prices include VAT. As of today, no discounts are available for this offer.
Vouchers cannot be redeemed or applied for online purchases. Vouchers can only be redeemed at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) when purchasing Urban Golf tickets.
5.4 Payment
For online purchases, fees may be paid by credit card (Mastercard, Visa, Postcard), online banking using PostFinance Card E-Finance, or via the online payment service TWINT. At the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden), payment in cash or by credit card (Mastercard, Visa, Postcard) is possible. Payment directly at the material pick-up point is not possible.
5.5 Returns & Exchanges
Exchanging or returning purchased tickets is excluded.
5.6 Damage and Loss of Materials
Participants are required to handle the Urban Golf equipment provided (club, ball, lanyard with “Bäseli”) with care and return it in proper condition.
5.6.1 Loss of Equipment
In case of loss of one or more items, the corresponding amount must be paid directly at the Grand Casino Baden via TWINT. If no TWINT access is available within the group, a payment slip will be provided by the issuing office.
5.6.2 Damage
A club is considered damaged if it is bent, broken, split in half or rendered unusable in a similar way. For the remaining equipment (balls, lanyard, Bäseli), the assessment of damage is at the discretion of the issuing office.
5.6.3 Costs in Case of Loss or Damage
Lanyard with Bäseli: CHF 2.00
Ball: CHF 2.00
Club (children): CHF 30.00
Club (adults): CHF 40.00
5.7 Insurance
TRB AG accepts no liability for accidents occurring on the Urban Golf course. Insurance is the responsibility of the participants.
5.8 Personal Data
For online purchases, the customer data required for ticket sales is transmitted in encrypted form (SSL).
In the event of damage or loss, TRB AG reserves the right to forward the customer data required for identification to the relevant authorities or public safety bodies (police).
6. Brokerage of Third-Party Services
(such as reservations of hotel rooms, conference rooms, and restaurant arrangements, as well as the sale of event tickets and vouchers)
6.1 Conclusion of Contract
When brokering third-party services, TRB AG is not a contracting party. TRB AG sells on behalf of and for the account of the third-party provider. The respective terms and conditions of the third-party provider apply. The contract between the customer and the third-party provider is concluded upon reservation or sale carried out by TRB AG.
6.2 Liability & Complaints
For third-party services brokered by TRB AG, any liability of TRB AG is excluded. Any complaints regarding the brokered service must be addressed exclusively and without delay to the third-party provider.
6.3 Contractual Conditions
The purchase conditions applicable to the respective third-party service provider are listed separately for each enquiry or order and are binding for both contracting parties.
7. Other Goods or Services
7.1 Conclusion of Contract
The contract is concluded between the customer and TRB AG. The purchase of goods at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) also falls under this provision.
7.2 Prices
All prices include VAT. Price changes are reserved; however, the prices valid at the time of ordering or agreement are binding.
7.3 Payment
TRB AG
For services provided by TRB AG, an invoice will be sent promptly by post or electronically by email. The agreed service will only be provided by TRB AG once full payment has been received.
Info Baden Tourist Office
For the purchase of goods at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden), payment is generally made directly in cash, by credit card (Mastercard, Visa, Postcard), or via the online payment service TWINT. In exceptional cases, TRB AG grants payment by invoice. In such cases, the invoice will be sent promptly by post or electronically by email. Goods remain the property of TRB AG until full payment has been received.
7.4 Late Payment
For purchases on account, the amount must be paid within 30 days of the invoice date without deductions. If payment is not made within 30 days after the due date, the customer is in default. In this case, TRB AG reserves the right to charge reminder fees in addition to the invoice amount. While no fee is charged for the first reminder/payment notice, the fee for the second reminder is CHF 10.00 and CHF 20.00 for the third reminder. The outstanding invoice amount (including interest on arrears and reminder fees) may be transferred or sold to a debt collection agency for collection.
7.5 Returns & Exchanges of Goods from the Info Baden Tourist Office
Defects must be reported immediately at the time of purchase. Otherwise, the goods are considered accepted by the customer in perfect condition. Returns due to dislike are excluded.
7.6 Youth Protection
TRB AG does not sell alcohol to persons under the age of 18. By purchasing such products, the customer confirms that they are at least 18 years old and meet the legal requirements.
8. Severability Clause
Should any provision of these GTC be invalid, the validity of the remaining provisions shall not be affected. If a provision is only partially invalid, the remaining part shall remain valid. The parties shall replace any invalid provision with a valid one that comes as close as possible to the economic purpose of the invalid contractual provision.
9. Data Protection and Data Security
The secure transmission of personal data and the optimal protection of the customer’s privacy are of great importance to TRB AG. TRB AG complies with all current data protection regulations. Further details can be found in the privacy policy.
10. Disclaimer of Liability
TRB AG is not liable for damages resulting from transmission errors, technical defects or disruptions, operational failures, unlawful interference with the IT systems of the user or third parties. TRB AG also assumes no liability for damages caused by publicly accessible systems and transmission networks, nor for damages resulting from interruptions (including system-related maintenance work) or overloads of IT systems.
11. Applicable Law
Swiss law applies to the entire legal relationship between TRB AG and the customer.
12. Place of Jurisdiction
The exclusive place of jurisdiction is Baden, unless another jurisdiction is mandatorily applicable under the Swiss Code of Civil Procedure.
13. Final Provisions
TRB AG reserves the right to amend the GTC. The version of the GTC that is valid and published on the website at the time of the order or purchase is binding for the conclusion of the contract.
